This Privacy Policy explains the processing of personal data for users of Kwaju Africa platforms, including our website and mobile app, in accordance with the General Data Protection Regulation (GDPR). Data Subjects can access details on the processing and their rights through our main website: kwaju.com >> Privacy Policy, or in the app under My Kwaju >> Terms & Conditions.

This privacy notice does not apply to third-party websites where our online advertisements are displayed or to linked third-party websites we do not operate or control. These websites should have their own privacy notices, which you can review to understand how they collect and process your personal data and your rights.

3. Data Collection: What Type of Data Do We Collect?

a) The Data We Collect

Kwaju Africa may collect the following types of personal data about you, as relevant and permitted by law:

i) Data Provided by You, a User of Kwaju Africa Services
  • Account Information & Identification Data: Information that identifies you, such as your first and last name, date of birth, user login credentials, address, and profile picture.
  • Contact Data: Information that allows us to address, send, or communicate messages to you, such as your email address, phone or mobile number, and residential or business address.
  • Financial Data: Payment details necessary to provide relevant products and services, such as debit or credit card details and mobile money information.
  • Demographic Data: Information such as birth date/age and gender, collected where necessary to enable certain features or provide access to age-restricted products or services. We also collect demographic data, such as age group and household composition, through user surveys.

  • Location Data / Geolocation Information: Information about your approximate or precise location when you access or use our services, such as your internet protocol (IP) address or your cookies identifier.
  • Transaction Information: Data related to your use of our services.

  • Service Providers: Information from providers who help us verify users’ identity, detect fraud, and screen users in connection with sanctions, anti-money laundering, or know-your-customer requirements.
  • Partner Transportation Companies: For drivers or delivery persons who use our services through an account associated with such a company.

  • Marketing Partners and Service Providers: Information from marketing partners and service providers, including banks in connection with cashback programs and data resellers.
  • Law Enforcement Officials: Data from law enforcement officials as required.

Content You Post Online Any information you post or disclose on message boards, chat, profile pages, blogs, and other services, including through social media outlets, may be collected, used, and disclosed by Kwaju Africa as described in this Privacy Notice. Such information is also viewable by other users.

Business Operations: To operate our business, such as creating, maintaining, and renewing your membership, billing, accounting, improving our internal operations, securing our networks and systems, detecting fraudulent, illegal, or unauthorized activity, and monitoring trends, usage, and activities in connection with our services and warehouses.

  • With couriers for collecting and delivering products.
  • With contracted services to manage incidents or negative feedback.
  • With payment platforms and service providers to process transactions.
  • With telecommunications providers for order related communications.
  • With providers offering satisfaction surveys on Kwaju Africa’s behalf.

5. How do we protect your personal data?

Kwaju Africa uses a high level of protection, both organizational and technical measures, to ensure that we process and store our customer data safely.

Some of the measures are:

  • Secure servers that meet the highest standards of security using firewalls, secure content delivery and secure architecture.
  • Access to data via secure login, restricted to IT teams.
  • Encryption of PINs  using industry-accepted hashing algorithms. (Crypto)

6. Data retention and deletion

Kwaju Africa retains your data for the duration of our contractual relationship and, once it ends, for the period required by law for filing or defending legal actions.

We keep records as long as necessary to:

  • Manage purchases, memberships, and provide other relevant products or services, including marketing updates and platform management.
  • Personalize products, services, and communications.
  • Comply with legal record retention requirements.

When determining how long to retain your personal data after our relationship ends, we consider legal obligations and regulatory expectations.

Account Deletion Requests

Users can request account deletion by sending an email to members@kwaju.com, clearly stating their desire to delete their data or by filling the form linked: HERE. After receiving a deletion request, we will remove the user’s account and data, except as needed for safety, security, fraud prevention, legal compliance, or to address outstanding issues such as unresolved claims or disputes.

If you wish to stop using our services, please contact us at members@kwaju.com . However, we will retain and use your registration information as necessary to meet legal obligations, resolve disputes, and enforce agreements.

7. Choice and Transparency/Rights

We offer choices regarding the personal information we collect. These choices apply only to you and do not affect household or business affiliates linked to your membership account.

To opt out of promotional materials from Kwaju Africa, use the “unsubscribe” link in any marketing communication or contact us by:

Cookies and Related Technologies

You can opt out of targeted advertising cookies and digital trackers by visiting the Cookie Settings page on web.

Notifications

You can manage text messages (SMS) and mobile notifications. We send SMS communications with your consent, including order and delivery updates, and in emergencies or urgent situations. Reply “STOP” to any SMS to cancel. To stop push notifications from our app, adjust your mobile device settings.

Please note that disabling Push notifications will also prevent you from receiving notifications about your order status.

Device Permissions

Location services are required for accurate delivery. If you use our mobile apps, we will ask for your consent to use your device’s precise location information to enable delivery and other features. If you decline consent, we will not collect this data, but some app features may not function. You can withdraw consent at any time by turning off the location feature in your device settings.

Accessing Your Information

You can request information about your membership and the personal data we have collected through the contact methods listed above. We may decline requests that are unreasonable, prohibited by law, affect others’ privacy, or where we cannot authenticate you.

Your Rights

You may exercise the following rights with Kwaju Africa:

  1. The right of access to your personal data to know which data is being processed and the processing operations carried out thereon;
  2. The right to correct any inaccuracies in relation to your personal data;
  3. The right to the erasure of your personal data, where possible; by sending us a data erasure request
  4. The right to request the restriction of processing of your personal data when the accuracy, legality or need for processing of the data is in question, in which case we may retain the data for the purpose of filing or defending claims.
  5. The right to request portability of your data to another service provider. We will give you a copy of your data so that you can provide it to another service provider. If you request us to do so and it is technically possible, we will transfer the data directly to that other service provider on your behalf.

Our platforms are not intended for children. If you provide personal data of children under 18, you are affirmatively giving us your consent as the legal parent or guardian to collect, use, and process the child’s information in accordance with this Notice.

We may update this Privacy Notice periodically and will make an effort to inform registered users of significant changes. All changes become effective upon posting unless stated otherwise.
